Legal advice: Right to extra benefits in the new collective labor agreement
After a long career as a teacher in primary education, I stopped working on 1 July 2018. Am I still entitled to the one-off payments agreed at the end of June in the new CLA?

Last summer voted the AObmembers with the new collective labor agreement for primary education. Two one-off payments have been agreed in that collective labor agreement, both of which will be paid out in October 2018.
In the first place there is the one-off payment of 750 euros gross. This applies to all employees working in primary education. The one-off payment is calculated in proportion to the number of employment and years of service over the period from January 2018 to August 2018. For full-time employment, the monthly accrual amounts to 93,75 euros gross.
Second distribution
The second one-off payment only applies to employees in an L scale: previously LA, LB, LC and LD and since last month L10, L11, L12 and L13. In October 2018, this group of employees will receive, in addition to the one-off payment mentioned above, an extra payment amounting to 42 percent of the full-time salary in September 2018.
This benefit is calculated on the basis of an accrual of 5,25 percent in proportion to the amount of employment per month over the period from January 2018 to August 2018. For employees who are no longer employed in October 2018, the allowance is calculated on the last-earned salary .
Post payment
The teacher who stopped working on 1 July is therefore entitled to a supplementary payment from her previous employer. This also applies to other primary school teachers who stopped working between January 1 and September 1, 2018.
