School was allowed to suspend a student for misconduct of parents
One of the primary schools of the Foundation for Public Primary Education Western Garden Cities in Amsterdam did the right thing by suspending a student because of the misconduct of his parents. The judge ruled in a judgment at the end of last week. The pupil must attend another school in his last year of primary school.

Because teachers feel intimidated by the child's parents, the student has been suspended. The judge sets the pronounciation first that the school has no problem with the child. It is a quiet student, nothing to blame for him.

The judge's decision has everything to do with the behavior of his parents. The judge considered whether the 8th grade student could finish his primary school career at his own school. The parents would like him to stay at his own school, but the judge has decided that it is not allowed. This is partly due to three incidents that took place in November and December 2018. As a result, there is a 'seriously disrupted relationship' between the parents and the school. The father in particular has, according to the judge, seriously misbehaved.

For example, there was destruction and threats on December 6, 2018. It was the father who did this, but the mother was also shouting in the school, as can be read in the statement. Moreover, it was not the first time that the parents had misbehaved. It made the teachers feel unsafe and anxious. 'The teachers are walking on eggshells when it comes to dealing with the child, for fear of a reaction from one of the parents,' said the judge. With the mother's argument that this fear is not that bad because teachers simply greet her, the judge does not go along. "The fact that the teachers greet the mother out of courtesy does not mean that they do not experience the aforementioned feelings."

In its defense, the school points to the manner of communication since the incident in December: everything is done by email or via others. Parents are not allowed to come to the school. According to the school, this is not a long-term solution and is not in the best interest of the child. The judge does not find it a solution either. "The school cannot be asked to maintain this situation for an entire school year," said the judge.
This case was previously ruled on 13 June. Then the judge found that the child was allowed to finish his year in grade 7, because only seven weeks remained. In June, the school had insufficiently explained why the student had to be expelled from the school. Education was more important at the time.
Appropriate schools
This time the school has better motivated why the child has been removed from the school and the judge finds that it was a decision that did not take place overnight. For example, the school contacted thirteen primary schools to place the pupil there. She gave the parents several options, but the mother refused to cooperate in the exchange of personal data and turned down schools because they were 'too far' or 'unsuitable'. Now there is room at a primary school within the current public schools foundation. The pupil can go there immediately, but the mother does not like it because the new school works with a different learning system.
Nevertheless, the student will now have to go to another school. The judge noted that this must be done as soon as possible and calls on the parents to give the last school within the school foundation a chance, so that their child can start his year in grade 8 as soon as possible. The student himself was also heard at the hearing. He wants to stay at his current school because of his friends and his class that he has known since grade 1.
