Legal advice: What can you do with the hours for sustainable employability?
Can you use the hours in secondary education for parental leave if the original parental leave has already been used up? And: can you save the hours in primary education for your pension or have it paid out?

In primary education, every employee has an annual basic budget of 40 hours for sustainable employability (part-timers pro rata). The hours are intended for peer review, study leave, coaching, orientation on mobility and work that is not bound to place or time. And in consultation for other purposes. “You may save up these hours for a maximum of three years for a written purpose,” says Wim Gulitz of the Information and Advice Center (IAC) of the AOb.
Starters and older colleagues
In addition, starters are entitled to 40 extra hours per year and employees from the age of 57 to 130 extra hours (against a personal contribution of 50 percent) for sustainable employability. “It is possible to save these hours, together with the basic budget, for five years on the basis of a previously submitted plan. Hours for long-term employability cannot be used to retire earlier, they are not retroactive and are not paid, ”Gulitz explains.
Supplementary parental leave
In secondary education, every employee is entitled to 50 hours per year for sustainable employability. A teacher is not allowed by his employer to save these hours for additional parental leave because the original parental leave has already been used up. “This is not correct, because in principle an employee in secondary education decides for himself how he wants to use the hours and also whether he uses them for extra (parental) leave. An employer can only influence this choice if there are demonstrably compelling financial or organizational reasons, ”says Gulitz.
