Legal Advice: Scale up, step down
If I am promoted to a higher salary scale, it turns out that I have been scaled one step lower. That's right, two primary school teachers wonder. AObemployee Wim Gulitz answers.

A teacher transfers from primary education to special education. From scale LA and step 3 she goes to LB also step 3, while otherwise she would have gone to step 4. “The starting point is that the starting salary in a higher scale must be at least equal to the current salary”, explains Wim Gulitz of the Information and Advice Center of the AOb from. This teacher received a gross salary of 2539 in scale LA and the gross salary in step 3 of scale LB is 2655 euros. “The classification is therefore correct”, Gulitz observes. The gain is in the higher maximum salary: 3826 in LB versus 3482 in LA.
Allowances
Another teacher in primary education has been appointed to an LB position. She was at the end of LA scale and went down one step in LB. Is that always the case and what does that mean for the binding allowance, she wonders. The CLA-PO provides for two allowances for employees who have reached their maximum salary, the binding allowance and the scale extension amount. “Both the binding allowance and the scale extension amount are included in the calculation of the new salary,” says Gulitz. Her gross salary including allowances is indeed one step lower in LB. "She is then no longer on the maximum salary of her scale and is therefore not entitled to a binding allowance until she reaches LB, step 15 a year later."
