Avicenna in error with the appointment of director
The Avicenna College in Rotterdam has no director now that the appointment has been declared unlawful by the National Commission for Disputes WMS. Avicenna had appointed an internal candidate outside the participation council. The mr argued against this and argued that the intended director is unfit for his task.

Avicenna College, the only school for Islamic secondary education in Rotterdam, has been rumbling since 2017. A series of dispute procedures between director and interim director Wim Littooij and the mr did not improve relations.
The most recent judgment of 19 June has again put Littooij in the wrong: the competent authority is obliged to undo the consequences of the appointment decision. This means that the school is actually without a director and the situation is back to October 29, 2019, when Littooij announced that the recruitment of a new director would start.

The director wanted to keep this appointment in his own hands as much as possible: he would appoint both the appointment committee and the advisory committee with staff members, without the involvement of the mr. After internal discussions, the mr was still represented, but then the director determined which mr member who position. The majority of the council protested, but the chosen one took his place. Subsequently, the appointment of Yassine Griep, one of the team leaders, was announced without further consultation with the mr. His directorship was due to take effect on June 1.

At the disputes committee, the director maintained that he had indeed consulted about the director's position with the mr, through the representative appointed by him. The disputes committee sees this differently. Insofar as the disturbed communication between the director and the mr resembles a request for advice, this is seriously below par: there is no motivation for the appointment decision and the mr does not receive any information about the background of the candidate. The mr and the director have not consulted for more than six months because Littooij does not appear at meetings.
Motivation
Given the opinion of the employee participation body about team leader Griep, a motivation would have been obvious. The mr gave a negative advice about the candidate, partly because the quality of education at the school under his leadership has been declining for two years now and the quality of the discussions about the standard annual task and performance are 'well below standard'. Furthermore, Griep wrongly terminated contracts of colleagues and put people under pressure, according to the mr advice that is included with the ruling.
It is also remarkable that Griep has spoken in various media on behalf of Avicenna as deputy director, but he was never formally appointed in that position either.
Inadequate
The Disputes Committee does not attempt to make a judgment about the candidate in its decision, but gives the procedure such a serious insufficient that the decision cannot be upheld.
In a second, simultaneously handled case, director Littooij tried for the third time unsuccessfully to have the mr of the Avicenna College dissolved by the disputes committee.
According to the director, the mr refuses to cooperate with him and only new elections can improve the situation. The committee rejected that request: dissolution is an extreme remedy if a mr does not adhere to rulings in previous disputes. That is not the case here.
Delighted
It is uncertain whether the consultation between the mr and the director will start again. Mr Chairman Judith Kraak is pleased with the statements: “This proves that a mr is not toothless. You do have something to say. ”

Not interested
Littooij says through the operator of the Avicenna College that he is not interested in a conversation about the latest developments. The same applies to chairman Carla Grootjen of the supervisory board.
Yassine Griep, who was removed from the management position by the disputes committee, was still listed as director on the website of the Avicenna College and on LinkedIn on 24 June. Griep has also been asked for explanations several times by telephone and e-mail, but does not respond.
The competent authority of Avicenna College can still appeal against the decision of the disputes committee.
